O R D E R

% 23.02.2018 The dispute between the parties arise out of marital discord. Presently four matters are pending before the Family Courts, they including Guardianship and Ward Petition registered as No.G-21/11, instituted by the petitioner (husband / father) against the respondents; application under Order 9 Rule 13 CPC instituted by the first respondent (wife) against ex parte decree of divorce; application under Section 340 Cr. PC instituted by the petitioner against the first respondent; and application under Section 125 Cr. PC instituted by the respondents against the petitioner. While the first mentioned case, i.e. Guardianship case, is pending on the file of the Principal Judge, Family Court for South District at Saket Courts Complex, the other matters are pending on the file of the Principal Judge, South -East District at Saket Courts Complex.

In response to the notice on the transfer petition, the respondent has appeared through her father.

Both sides have been heard. Though the request in the transfer petition was for the case under Section 125 Cr PC (M/16/214 of 2016) to be moved from the Family Court for South-East district to the Family Court for South District, it is now agreed by both sides that all the cases be brought together before the Principal Judge of Family Court for South-East District at Saket in as much as the respondents are presently residents of Greater Kailash, Part-2, New Delhi which falls within the jurisdiction of the said court. Thus, the petition is disposed of with direction that all the three above mentioned matters pending on the file of the Principal Judge, Family Court for South-East District at Saket shall stand transferred for further proceedings in accordance with the law to the court of the Principal Judge, Family Court for South District at Saket Courts Complex. The transferor court shall make over the files to the transferee court fixing an appropriate date for the parties to appear there.

The petition is disposed of in above terms.
