O R D E R

% 16.11.2017 Learned counsel for the petitioner submits that complainant is the brother-in-law of petitioner. Petitioner is a Commission Agent. He facilitated a deal between J J Export and the complainant's father, pursuant whereof JJ Export supplied material worth `20 lakhs to the complainant's father.

Out of `20 lakhs, only `8 lakhs was paid.

Petitioner asked the complainant's father to pay this amount at which he got angry. Petitioner has been falsely implicated. As per the FIR itself the petitioner and co-accused were not armed with any weapon at the time of incident. Complainant is niece of petitioner. Nothing is to be recovered and no custodial interrogation is required. Learned APP, who is assisted by learned counsel for the complainant, has vehemently opposed the grant of anticipatory bail to

petitioner.

It is contended that petitioner and co-accused forcibly entered in the complainant's house and assaulted the complainant and her parents. It is contended that the petitioner and the co-accused had also molested the complainant.

Keeping in mind the totality of circumstances, it is ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `10,000/-(Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.
