For the reasons stated in the application, the application is allowed.
CRL.M.C. 131/2018 1.
Petitioner seeks quashing of FIR No.144/2008 under Sections 381/419/420/468/471 IPC PS Darya Ganj.
The allegations are that the petitioner who was working with the respondents misused certain blank cheques signed by the respondents and encashed some of the cheques.
CRL.M.C. 131/2018
2.
Respondent no. 2 to 4 are present in person in Court today and also represented by their counsel. They submit that they have settled all the disputes with the petitioner at a total amount of Rs.60,000/-. The entire amount of Rs.60,000/- already stands paid. They further submit that they do not wish to press the criminal complaints against the petitioner any further.
3.
In view of the fact that the disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace and harmony are restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.
4.
Accordingly, the subject FIR No. 144/2008 under Sections 381/419/420/468/471 IPC PS Darya Ganj, as well as the consequent proceedings arising therefrom are quashed, subject to the petitioner depositing costs of Rs.10,000/- with the "Prisoners Welfare Fund, Jail No. 13, Mandoli", Mangal Pandey Marg, Harsh Vihar, Village Mandoli, Delhi, within a period of two weeks from today. Receipt of deposit of the costs imposed by this Order be furnished to the concerned Investigating Officer within a period of three weeks from today.
