% 05.12.2018 CAV No.1124/2018 Since the learned counsel for the caveator/respondent puts in appearance, the caveat stands disposed of.

CM APPL No.50910-11/2018 Exemption allowed, subject to all just exceptions. The application(s) stand disposed of.

RC.REV. 586/2018& CM APPL No.50909/2018 This petition challenges the impugned order 17.07.2018 passed by the learned Trial Court against the petitioner. After arguing for sometime, the learned counsel for the petitioner submits the petitioner shall be satisfied with the impugned order if a period of one year and three months more is granted to the petitioner to vacate the premises in question. The learned counsel for the respondent agrees to the proposal provided some user charges be given to the respondent for the use of the premises with effect from 01.12.2018.

In the circumstances, the user charges @ Rs.10,000/- be paid by the petitioner to the respondent with effect from 01.12.2018 till 29.02.2020 besides the electricity and water charges as per the actuals. The petitioner shall not sub let, assign or transfer the premises in question to some other person during his occupation. The respondent shall not pursue the execution proceedings till 29.02.2020 against the petitioner.

The petitioner shall file an undertaking to the above effect within one week from today with an advance copy thereof to the learned counsel for the respondent.

With the above observation, the petition is disposed of with no order as to cost. The pending application also stands disposed of. Order dasti to both the parties.
