% 12.12.2018 This petition challenges the order dated 28.07.2018 whereby the defence evidence was closed as the petitioner had failed to lead the evidence on three occasions. The learned counsel for the petitioner submits he may be given only one opportunity to examine his only witness.

In the circumstances the order dated 28.07.2018 is set aside and the petitioner is allowed to examine his only witness namely Mr.Taranveer Singh/defendant no.3 whose affidavit is already on record. The matter be taken up by the learned Trial Court on the date fixed.

Petition and pending application stands disposed of in terms of above subject to a cost of Rs.10,000/- to be paid to the learned counsel for the petitioner.
