CM(M) 1483/2018& CM APPL No.50905/2018 This petition challenges the impugned order dated 13.09.2018 whereby the learned Trial Court rejected the application of the petitioner under Order VII Rule 11 CPC holding the suit is primarily for damages which the plaintiff / respondent has suffered while contesting the complaint case filed by the petitioner before the District Consumer Redressal Forum, Kashmere Gate, Delhi. It is further observed the said damages are qua the payments made to the counsels, mental harassment as also qua the losses suffered in the business due to court hearings.

The learned Trial Court while passing the impugned order has considered the material facts/documents available on record and there is no infirmity in the impugned order, accordingly, the petition is dismissed. The pending application also stands dismissed. YOGESH KHANNA, J.
