% 03.12.2018 Though the impugned orders passed in the execution proceedings (execution case no. 56/2018) have been passed in the context of an order secured by the respondent under Sections 125/127 of the Code of Criminal Procedure, 1973 (Cr.P.C.), the fact remains that the said orders have been passed by the Presiding Judge of Family Court for South-East district, and the remedies against the orders of the family court will have to be located in and pursued in accordance with the provisions of Family Courts, Act, 1984, the jurisdiction of this Court under Section 482 Cr.P.C being not such remedy inasmuch as the forum which has passed the said order is not a criminal court.
In view of the above observation, the learned counsel for the petitioner now seeks permission to withdraw the present petition submitting he would pursue appropriate remedies available in law. Ordered accordingly.
