% 19.12.2018 Respondent no.2 Ms. Anju is present in Court and has been identified by SI Karamvir of police station Narela.
She submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion vide a compromise deed dated 29.09.2018. Respondent no. 2 submits that her marriage with petitioner no.1 has already been dissolved by a decree of divorce by mutual consent dated 6th December, 2018 passed by the Family court, District North, Rohini Courts Delhi. Respondent No.2 submits that she has received the entire settlement amount of Rs.2.5 lakhs. Respondent no.2 submits that with this payment
entire settled amount stands paid and she has no objection in case FIR No. 187/2018 under Sections 498A/406/34 IPC registered at police station Narela is quashed. The affidavit of respondent No.2 is also on record to this effect.
Keeping in mind the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
