This petition under Article 227 of the Constitution of India impugns the order dated 1st November, 2017 in [E-457/14/05 (New no. 77411/16) of the Court of Additional Rent Controller, THC, Delhi] of dismissal of the application filed by the petitioners for appointment of a handwriting expert and closing the evidence of the petitioners and listing the petition for eviction under Section 14 (1) (e) of the Delhi Rent Control Act, 1958 filed by the respondent in the year 2005 for final arguments on 23rd November, 2017. 2.

After some arguments, the counsel for the petitioners CM(M) 1317/2017

withdraws this petition with liberty to, if remain aggrieved from the final order in the eviction petition, in the remedy if any preferred there against, also challenge the order impugned in this petition including on the grounds, as urged in this petition. 3.

Dismissed as withdrawn with liberty aforesaid. 4.
