RFA 1020/2017 and C.M. Appl. Nos. 44022-23/2017 1.
After arguments, this appeal is disposed of with the consent order that the impugned judgment passed by the trial court dated 22.8.2017 is set aside, however, both the parties will not get more than three opportunities each to complete their evidence in affirmative. If any of the parties fail to complete their evidence in three opportunities, with maximum one more grace opportunity, then the evidence of the said party will be closed. RFA 1020/2017

Trial court is requested to complete hearing of the final arguments within around three months of completion of evidence and thereafter the trial court is requested to expedite the disposal of the suit by passing a judgment.

Parties to appear before the concerned trial court on the date fixed i.e. 2nd February, 2018, along with a copy of today's order so that the trial court will now fix a date for reframing of issues. 4.
