CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 24.01.2018 By this petition the petitioner challenges the communication dated 4th September, 2017 whereby his application for grant of parole was dismissed by the competent authority on the ground that six months' had not elapsed from the grant of the first parole to the petitioner. As per the Nominal Roll the petitioner was granted parole by this Court w.e.f. 22nd February, 2017, which was extended up to 12th May, 2017 in view of the medical condition of the father of the petitioner. It is thus evident that at that stage the petitioner availed parole for a period of nearly 80 days. Since six month period from the last surrender on parole has elapsed, the petitioner would be at liberty to apply to the Government for parole W.P.(CRL) 3310/2017

again. Granting leave to the petitioner to approach the Government for parole again, at this stage, this Court finds no ground to interfere in the order dated 4th September, 2017.

The petition is dismissed.

Order dasti.
