Transfer, invoking Section 24 of the Code of Civil Procedure, 1908, is sought of Suit No.600003/2016 titled 'Atul Dewan vs. Inderjit Gandhi and Others' of the Court of Sh. Arun Kumar Garg, Civil Judge-04, Central, Delhi to the West District on the ground of the property subject matter of the Suit being in West District.

The Suit was admittedly instituted before the bifurcation of Delhi into Districts and all pending Suits are to remain in the Central District only. Thus, merely because the property to which the Suit is stated to pertain is in the West District, is no ground for transfer. TR.P(C) No.186/2017

The counsel for the petitioner/plaintiff draws attention to the order dated 12th July, 2017 in the Suit.

A perusal of the said order shows that the Suit is ripe for final arguments and on the statement of the counsel for the petitioner/plaintiff that he will apply for transfer, the hearing of final arguments was adjourned to 1st September, 2017.

No ground for transfer is made out.

Dismissed.
