Crl. M.A. 2873/2018 (condonation of delay in re-filing) IN CRL.M.C. 787/2018 For the reasons stated in the application, the delay in re-filing
the petition is condoned. The application is disposed of. CRL.M.C. 787/2018 & CRL.M.C. 784/2018 1.
In these petitions, the respective petitioners seek quashing of the corresponding cross FIRs registered against each other on the basis of a settlement.

The Petitioners, in CRL.M.C. 787/2018 seek quashing of FIR No. 2284 of 2015 under Sections 354/506/509/34 of the IPC Police Station Shakarpur, Delhi and the Petitioners in CRL.M.C. 784/2018 seek quashing of FIR No.
of under Sections 354B/506/509/34 of the IPC Police Station Shakarpur, Delhi. The dispute is between family members.

The parties have entered into a family settlement dated 06.11.2015 as well as settlement through the process of mediation held at Delhi Mediation Centre on 10.11.2015. Thereafter statements of the parties were also recorded under Sections 164 Cr. P.C. on 27.11.2015 wherein they confirmed the settlement and contended that they did not wish to proceed against each other. 4.
Both the parties are present in person in Court today, represented by their counsels and are identified by the Investigating Officer. They submit that they have settled their all disputes with the intervention of the elders and respectable family members. They further submit that they do not wish to press the criminal complaints against each other any further.

In view of the fact that the disputes between the parties has been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating there from.

In view of the above, the petitions are allowed. FIR No. 2284 of 2015 under Sections 354/506/509/34 of the IPC Police Station Shakarpur, Delhi and FIR No. 2285 of 2015 under Sections 354B/506/509/34 of the IPC Police Station Shakarpur, Delhi and the consequent proceedings emanating there from are, accordingly quashed.
