% 10.01.2018 Petitioner had approached the Central Administrative Tribunal, New Delhi, who vide order of 18th May, 2017 [Annexure P-10 (B)] had issued a direction to respondent to consider petitioner's case for compassionate appointment in light of applicable guidelines within a period of three months. Vide order of 19th July, 2017 (Annexure P-11) respondent has intimated petitioner that at present there is no vacancy available to provide compassionate appointment to petitioner. Learned counsel for petitioner submits that respondent should provide material to support impugned order as petitioner desperately needs compassionate appointment to survive and to seek speedy relief, petitioner has approached this Court.

Since petitioner had approached the Central Administrative Tribunal, New Delhi in the first round of litigation, therefore, petitioner is relegated to avail of remedies against impugned order (Annexure P-11) W.P.(C) 255/2018

before Central Administrative Tribunal, New Delhi. With aforesaid observations, this petition and the applications are disposed of.
