The petitioner seeks bail in FIR No.274/2017 under Section 392/397/34 IPC, Police Station Hauz Khas. The contention in the FIR is that the complainant was riding on his motorcycle when three boys on another motorcycle stopped his way and at gun point snatched his motorcycle as well as mobile phone.

As per status report, the petitioner has been arrested only on the basis of the statement of a co-accused. The petitioner has been incarcerated since 30.08.2017.

The investigation is over and the charge sheet has already been filed.

Keeping in view of the above facts, I am of the view that no purpose would be served in keeping the petitioner incarcerated at this stage.

In view of the above, the petitioner is directed to be released on bail subject to furnishing a bail bond of Rs.25,000/- with one surety of like amount to the satisfaction of the Trial Court. 5.

The petitioner shall not, in any manner, do anything which shall either prejudice the trial or the prosecution witnesses. 6.

It is clarified that nothing stated herein shall amount to expression of opinion on the merits of the case. 7.
