% 07.05.2018 By this petition, the petitioner seeks anticipatory bail in case FIR No. 112/2017 under Sections 380/34 IPC registered at Chitranjan Park. The above noted FIR was registered on the complaint of Pawan Kumar who stated that on the intervening night of 6th-7th October, 2017 he was staying in room No. 109 in Virat Residency, E-574, G.K.-II, New Delhi. At about 1.20 A.M. Deepak Tandon and his associate Nikhil along with two other associates came to his room and stole two mobile phones, three ATM cards, Driving Licence, Adhar Card, PAN card, ₹80,000/- cash and 20 grams of gold chain. They also stole the Lava mobile phone of receptionist. During investigation after Deepak Tandon was arrested. He disclosed the names of his co-accused, Nikhil, Ravi and Michal and stated that he along with Nikhil, Ravi and Michal came at E-574, G.K-II in Ravi's car and stole the articles and ran away from the spot. From Deepak one Lava mobile phone and a purse containing PAN card, ATM cards ( PNB, Central Bank of India and Syndicate Bank) and Driving License of the complainant were recovered. Thereafter Nikhil was arrested and at his instance nothing could be recovered. Considering the role assigned to the petitioner even as per the disclosure of the co-accused Nikhil though named in the FIR has been released on anticipatory bail and that the petitioner has joined the investigation, this Court deems it fit to grant anticipatory bail to the petitioner.
Consequently, in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that the petitioner will join the investigation as and when directed by the Investigating Officer.
