Caveat accordingly stands discharged.

RFA No. 1011/2017 & CM Nos.43694-95/2017 1.

After arguments, this appeal is disposed of with the consent order that the appellant/defendant will vacate the suit premises on or before 31.5.2018 but subject to the condition that arrears of rent/user charges from March 2017 at the admitted rent of Rs.50,000/- per month are cleared within one month from today. Within this one month the charges for the month of December will also be cleared by the appellant/defendant.

Appellant/defendant will pay month by month by the 15th of each month from January admitted charges of Rs.50,000/- per month.

Appellant/defendant will also clear all charges towards electricity water etc as per the bills raised by the local authorities for the suit premises. 2.

Let the appellant file an affidavit of undertaking in this Court in terms of the present order within one week and on the appellant/plaintiff filing an undertaking and complying with the terms of the same, appellant will get the benefit of time to vacate the suit premises on or before 31.5.2018.

The appeal is accordingly disposed of leaving the parties to bear their own costs.
