Both the parties submit that they have amicably settled and resolved all their disputes. Mr. Sushil Kumar, proprietor of respondent Firm states that he has filed one criminal complaint on account of dishonour of four cheques of Rs.50,000/- each against the appellant which is pending in the court of Ms.

Swati Gupta, bearing old case No.1018/2015 (New No.615991/2016 titled as International Sales Corporation Vs. M/s Paras Stores, which is listed for 03.01.2018. The appellant has agreed to pay total sum of Rs.3 lacs to the respondent in full and final settlement of his all claims.

Pursuant to the settlement, the appellant has paid a sum of Rs.2 lacs in the court to the respondent Mr. Sushil Kumar, Proprietor by way of DD No.509298 dated 14.12.2017 issued by ICIC Bank, Saket New Delhi. The

appellant undertakes to make the payment of balance amount of Rs.1 lakh on or before 12.06.2018 to the respondent. The undertaking so furnished by the appellant is accepted. The respondent has agreed to withdraw his criminal complaint on the next date of hearing i.e. 03.01.2018 in terms of this settlement.

In view of the settlement between the parties, the appeal stands disposed of.
