Without expressing any opinion on merits and whether the petitioner is entitled to any relief, the writ petition is dismissed as withdrawn. In case, the petitioner files an OM, the issue in question will be examined as per law i.e. by examining pleas and contentions

raised by the petitioner, and the defence and submissions of the respondent.
