+ CRL.M.C. 4852/2017 HITESH ANAND & ANR ..... Petitioners Through:
Mr. D.K. Sharma, Adv. along with petitioners in person.
versus THE STATE GOVT OF NCT OF DELHI & ANR..... Respondents Through:
Ms. Neelam Sharma, APP for State with SI Rajeev, P.S. Rajouri Garden Respondent no.2 in person.
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 02.11.2018 Respondent no.2 is present in Court and has been identified by SI Rajeev of police station Rajouri Garden.
It is submitted that petitioner no.2 is employee of respondent no.2; whereas petitioner no.1 is friend of petitioner no.2. Petitioner no. 2 along with petitioner no.1 attempted to withdraw the amount from the account of respondent no.2 on the basis of forged signatures. However, they could not succeed in withdrawing the amount. It is further submitted that petitioners and respondent no.2 have settled their disputes amicably, therefore, FIR No. 600/2017 under Sections 380/467/471 IPC registered at police station Rajouri Garden and the consequent proceeding may be quashed.
Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
