This petition under Section 14 and 15 of the Arbitration and Conciliation Act, 1996 has been filed praying for appointment of a substitute arbitrator in place of Late Justice S.K. Mahajan whose mandate was terminated on his unfortunate demise. 2.

The learned counsel appearing for the respondent submits that he has no objection if a substitute arbitrator is appointed. In that view I appoint Justice S.K. Agarwal (Retd.), [Address: A-62, Nizamudin East, New Delhi-110013, Ph. 24694807, 24656722] as a sole arbitrator to adjudicate the disputes that have arisen between the parties in relation to the Purchase Order dated 6th October, 2012. The arbitration will be conducted from the stage it was before Late Justice S.K. Mahajan.

The respondent would collect the record from the office of Late Justice S.K. Mahajan and transmit the same to the new appointed arbitrator.

The petition is allowed in the above terms with no order as to costs.
