After some arguments, learned counsel for the petitioner seeks permission to withdraw the petition. Learned APP for the State submitted that the petitioner has already moved an application for recall of process under Sections 82/83 of the Code of Criminal Procedure, 1973 („Cr.PC‟). However, learned counsel for the petitioner disputes the same.

Accordingly, the petition is dismissed as withdrawn, with liberty to the petitioner to move an appropriate application for recalling of the process under Sections 82/83 of the Cr. PC, if there is any. It is clarified that this Court has not expressed any opinion on the merits of the petition.
