CM Appl. No. 30256/2018 Learned counsel for the applicant submits vide order dated 13.01.2017 the petitioner was directed to pay user and occupation charges as per the market rate i.e.

15,000/- per month till the pendency of this petition. It is submitted revision petition was allowed in favour of the petitioner herein and she has since filed her written statement and presently eviction petition is under trial. It is submitted now since the leave to defend application is allowed, hence the amount so paid as user and occupation charges is liable to be refunded to the petitioner. Since there is no report of service on the respondent hence notice be again served upon the respondent and also

through the counsel for the respondent on filing PF for 17th May, 2019.
