% 29.11.2017 Learned counsel appearing on behalf of the appellant seeks leave to withdraw this appeal with liberty to file an appropriate application before the court of competent jurisdiction.

Leave and liberty granted.

The appeal is dismissed as withdrawn and disposed of accordingly. Pending applications also stand disposed of.

However, we observe that despite an order dated 14.12.2015 passed by this Court in MAT.APP.(F.C.) 131/2015, titled as 'Vikas vs. Vidya', the Family Court is yet to hear and adjudicate the application filed on behalf of the respondent herein under Section 24 of the Hindu Marriage Act, 1955 (for short 'the said Act'). We further observe that the said application has been pending since 24.03.2018.

MAT.APP.(F.C.) 207/2017

In this view of the matter, the learned Principal Judge, Family Courts, Shahdara, Karkardooma Courts, Delhi is directed to dispose of the said application under Section 24 of the said Act, expeditiously and preferably within a period of thirty days from the next date of hearing i.e. 05.12.2017, in accordance with law.
