O R D E R

% 22.11.2017 The petitioner's grievance is that the advertisement issued by the South Delhi Municipal Corporation for setting up of Unipoles, is contrary to the prevailing policy.

Learned counsel emphasises that this Court is seized of certain public interest litigation proceedings whereby the Corporations were enjoined to adhere to Outdoor Advertising Policy (OAP) 2007. It is also submitted that the issue with respect to correctness of the OAP 2017 is pending before the Supreme Court.

Learned Senior Counsel for the petitioner-Corporation submits W.P.(C) 10391/2017

that OAP 2017 applies in the present case and is being adhered to and that in the event any location needs to be shifted on account of the prevailing conditions; the bidders are suitably notified having regard to the general terms and conditions of the contract in the impugned advertisement.

In view of the statement made on behalf of the SDMC, the Court is of the opinion that there is no scope for interference, at this stage. The writ petition is therefore dismissed. S. RAVINDRA BHAT, J SANJEEV SACHDEVA, J NOVEMBER 22, 2017 'rs'
