% 25.07.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2 is present in Court along with his counsel, who accepts notice. He has been identified by SI Yogender Kumar of police station Tughlak Road. Respondent no.2 submits that he has settled his disputes with the petitioners of his own free will and without any undue force, pressure or coercion vide Memorandum of Understanding (MOU) dated 11th May, 2017. He further submits that terms of the MOU have already been complied with, therefore, he has no objection in case FIR No. 22/2017 under Sections 406/420/120B IPC registered at police station Tughlak Road and the consequent proceedings are quashed.
Keeping in mind the settlement arrived at between the petitioners and
respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
Miscellaneous application is disposed of as infructuous.
