% 13.02.2018 It is submitted that petitioner is cousin of respondent no. 2. A quarrel took place between them on some trivial issues, which led to registration of the present FIR no. 53/2016 under Section 308 IPC at Police Station Sarai Rohilla, on the complaint of respondent no. 2. Respondent no. 2 is present in Court and has been identified by ASI Raj Kumar of police station Sarai Rohilla.

With the intervention of their family members and common friends, petitioner and respondent no. 2 have settled their disputes amicably, vide a Compromise Deed dated 30th October, 2017. Respondent no. 2 submits that he has settled the matter with the petitioner of his own free will

and without any undue force, pressure or coercion and he has no objection in case the FIR is quashed. It is an admitted fact that respondent no. 2 had received simple injuries in the quarrel.

Keeping in view the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR no.

53/2016 under Section 308 IPC at Police Station Sarai Rohilla and the consequent proceedings emanating therefrom are quashed, subject to however, costs of `10,000/- with the Lawyers' Welfare Fund within four weeks and receipt thereof be produced before the Investigating Officer.
