O R D E R
% 12.12.2017 Learned counsel for the Decree Holder (in short DH) submits that Judgment Debtor Nos.2 to 5 (in short JD) have been impleaded in the present execution petition as whereabouts of JD No.1 company could not be traced. He submits that JD Nos.2 to 5 are the Chairman and Directors of JD No.1 company and they are necessary to be impleaded as they would be in a position to disclose the affairs of JD No.1. He further submits that earlier Execution Petition, being Execution Petition No.152/2007, was disposed with liberty to the DH to apply afresh once the DH is able to ascertain the whereabouts of JD No.1.
Learned counsel for the DH further prays that as the property of JD No.1 is located in Karnal, Haryana, the decree be transferred to the District
Court Karnal, Haryana. It is ordered accordingly. The Registry will issue the transfer certificate.
The petition along with pending applications are disposed of with the above direction.
