On prima facie consideration of the matter, this writ petition claims to have been filed in public interest seeking setting aside of the advertisement Nos.02/2016 (FC) and 04/2016 (FC) dated 7th April, 2016 and 17th June, 2016 respectively, issued by the All India Institute of Medical Sciences, New Delhi inviting applications for the various posts of Assistant Professor in different departments on the ground that the authority, as per the provisions of the All India Institute of Medical Sciences Act, 1956, has no power to relax qualification for a particular category applicable W.P.(C) No.10596/2017 Pg.1 of 2
only to AIIMS Delhi. It is pointed out that the same has not been permitted by AIIMS, Jodhpur.

In our view such writ petition is not maintainable as a PIL. 3.
In view of the above, learned counsel for the petitioner seeks leave to withdraw the writ petition.
Writ petition is accordingly dismissed as withdrawn. 4.
It is made clear that we have not expressed any opinion on the merits of the case.
