CORAM:

HON'BLE MS. JUSTICE INDERMEET KAUR

ORDER

% 12.01.2016 Learned counsel for the petitioner seeks transfer of the applications pending in Suit Nos. 300/2012 and 301/2012; the suits had been decreed and disposed of by the Additional District Judge of Dwarka Courts on 28.03.2012. Pursuant thereto i.e. about six months ago this Court has been informed that the said applications had been filed in those disposed of suits.

Relevant would it be to note that the jurisdiction of Revenue Courts of Vasant Vihar stood transferred to the Patiala House Courts. This is an admitted fact.

In this view of the matter, the applications should have been By:AMULYA

I) filed before the Patiala House Courts as the Dwarka Courts were no longer vested with the jurisdiction to deal with even the pending applications although initially the suits had been disposed of by the Additional District Judge of Dwarka Courts. This factual position being admitted, the prayer made in the present applications is allowed and the misc. Application No. 08/2015 pending in suit No. 300/2012 and misc. Application No. 09.2015 pending in suit No. 301/2012 will stand transferred to the Patiala House Courts. The file, if not already transferred, shall be transferred to the Court of District Judge, Patiala House Courts, New Delhi District. Parties shall appear before the learned District Judge of Patiala House Court on 25.01.2016 who shall either deal with the matter himself or assign it to any other competent Court.

With these directions, petitions disposed of. INDERMEET KAUR, J JANUARY 12,2016
