% 16.05.2018 After being shown the copy of the rejoinder with which the affidavit of the petitioner sworn on 01.11.2017 was sent by courier, as per the original receipt shown, on 02.11.2017, the counsel for the respondent fairly conceded to the prayer in the petition at hand to be allowed and the rejoinder of the petitioner to be allowed to be brought on record for being considered at the stage of arguments on the pending application of the petitioner for leave to contest. Ordered accordingly.
In the result, the impugned order dated 08.11.2017 declining opportunity for filing rejoinder passed by the Additional Rent Controller stands set aside.
The petition and the applications filed therewith are disposed of in above terms.
