By this petition the petitioner seeks anticipatory bail in case FIR No. 114/2017 under Section 308/34 IPC registered at PS Gulabi Bagh. 4.
The allegations in the FIR, lodged on the complaint of Akash, are that on 19 October, 2017 at about 11:30 pm he was in front of house No.10667 to wish diwali greetings to Avinash, who was his cousin. Vinay and Chirag the brothers-in-law of Avinash were also standing in front of their house. During discussion, hot talks took place. Vinay and Chirag BAIL APPLN. 2401/2017
assaulted him and Avinash brought an iron rod and hit him on the leg, chest and head. The main accused Avinash has already been granted regular bail. The role assigned to the petitioner Vinay is giving a blow by the hand. 5.
Considering the role assigned to the petitioner and the fact that a compromise has already been arrived at between the parties i.e. the complainant and the sister of the petitioner in respect of this FIR, this court deems it fit to grant anticipatory bail to the petitioner. 6.
It is, therefore, directed that in the event of arrest the petitioner will be released on bail on his furnishing personal bond in this sum of ₹25,000/- with one surety of the like amount subject to the satisfaction of the arresting officer/SHO concern, further subject to the condition that petitioner will join the investigation as and when directed by the investigating officer and will not leave the country without prior permission of this Court. 7.
The petition is disposed of.
