BAIL APPLN. 2864/2018 By this petition the petitioner seeks anticipatory bail in case FIR No. 76/2018 under Sections 306/304B/34 IPC registered at PS Bawana. This is the third anticipatory bail application filed by the petitioner. The first anticipatory bail application was withdrawn before this Court on 24th May, 2018 whereafter the petitioner filed another bail application being BAIL APPLN. 238/2018 wherein the factum of withdrawal of earlier bail application was not mentioned, hence the same was dismissed on 5th October 2018.

Learned APP for the State on instructions informs that the petitioner has already been declared a proclaimed offender on 20th November, 2018. Since the petitioner has already been declared a proclaimed offender in view of the decision of the Supreme Court reported as 2012 (8) SCC 730 Lavesh vs. State (NCT of Delhi) and 2014 (2) SCC 171 State of M.P. vs. Pradeep Sharma, the present petition seeking anticipatory bail is not maintainable. Further there is no change in the circumstances to entertain the third application for anticipatory bail.

Petition is dismissed.
