% 19.07.2018 After some hearing, learned counsel for the appellant, on instructions, seeks permission to withdraw the present appeal. However, he submits that the trial of the suit may be ordered to be expedited.

In view of the foresaid, we are of the opinion that it is for the parties to seek expeditious disposal of the suit pending before the learned Single Judge including the appointment of Local Commissioner to record the evidence.
