% 11.07.2018 Respondent no.2-Ms. Sandhya Arora is present in Court along with her counsel.
She has been identified by SI Dharamvir of CAW Cell, Nanakpura. Respondent no.2 submits that she has settled the matter with the petitioner no.1 before the Delhi Mediation Centre, Karkardooma Court, Delhi on 16th November, 2017 where petitioner no.1 was represented through his Attorney-Smt. Parvesh Arora.
She further submits that her marriage with petitioner no.1 has already been dissolved vide a divorce order dated 10th February, 2016 passed by Federal Circuit Court of Australia (Ex. P-2). She further submits that all the disputes have been settled before
the Mediation Centre including disputes involved in the present FIR No. 18/2016 under Sections 498A/406/34 IPC registered at Crime (Women) Cell, Nanakpura.
Petitioner no.1 is also present in Court today. He has handed over a demand draft of `2.5 lacs to the respondent no.2 today in Court, photocopy whereof has been placed on record.
Respondent no.2 submits that entire settled amount stands paid with this payment and she has no objection in case the aforesaid FIR is quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 to 5.
Keeping in mind the settlement arrived at between the petitioner no.1 and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending more particularly the fact that their marriage has already been dissolved. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
