CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 11.07.2018 Petitioner no.1 is mother-in-law and petitioner no.2 is brother-in-law of respondent no.2; whereas petitioner no. 3 is wife of petitioner no.2. On the complaint of respondent no.2, FIR No. 797/2014 under Section 380 IPC was registered against the petitioners at police station Krishna Nagar. It is submitted that FIR No. 18/2016 under Sections 498A/406/34 IPC was also registered against the husband and his relatives at Crime (Women) Cell, Nanakpura. There were other litigations with regard to matrimonial disputes pending between the respondent no.2 and her husband, namely, Manish Arora.

It is further submitted that all the disputes including the disputes

involved in the present FIR have been settled between the parties before the Delhi Mediation Centre, Karkardooma Court, Delhi on 16th November, 2017, inasmuch as, FIR No. 18/2016 under Sections 498A/406/34 has also been quashed by this Court vide order dated 11th July, 2018 passed in Crl. M.C. 4895/2017.

Therefore, it is prayed that present FIR may be quashed in view of the settlement.

Respondent no.2 is present in Court along with her counsel. She has been identified by ASI Jatin Singh of police station Krishna Nagar. She submits that she has settled the matter with the petitioner no.1 of her own free will and without any undue force, pressure or coercion. Petitioner no.1 has handed over a demand draft of `2.5 lacs to the respondent no.2 today in Court, photocopy whereof has been placed on record. Respondent no.2 submits that entire settled amount stands paid with this payment and she has no objection in case the present FIR is quashed against all the petitioners. Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings. Accordingly, in the interest of justice, FIR No. 797/2014 under Section 380 IPC registered at police station Krishna Nagar and the consequent proceedings emanating therefrom are

quashed.

Petition is disposed of in the above terms.
