O R D E R
% 03.01.2018 CM APPL. 128/2018 (for modification of order dt. 29.11.2017) The present application has been instituted on behalf of the petitioner praying as follows:- "(a) Modify the order dated 29.11.2017 passed in the matter;
(b) Pass such other further order/s as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."
Mr Ashok Mathur, learned counsel appearing on behalf of the petitioner states that although they had applied for a certified copy of the order dated 29.11.2017, of which modification is sought, on 30.11.2017 itself, the certified copy thereof was ready only on 15.12.2017 and delivered to the petitioner on 18.12.2017.
It is, therefore, urged that, in the meantime the period of two weeks granted by this Court to enable the petitioner to file an appeal had elapsed
and, consequently, the appeal came to be instituted after the period granted. It is in this backdrop that it is prayed that operative operation of the said order dated 29.11.2017 be modified to the extent that the petitioner be permitted to file an appeal within two weeks from the date of the availability of the order and not the date on which it was rendered. Directed accordingly.
The order dated 29.11.2017 is modified to the extent that the petitioner is permitted to file an appeal within two weeks from the date of the availability of the certified copy of the same and the Financial Commissioner is directed to dispose off the appeal as expeditiously as possible.
It is further directed that no coercive steps be taken against the petitioner for a period of four weeks from the date the certified copy of the said order dated 29.11.2017 was made available to the petitioner. With the above modification the application is disposed off. Dasti under the signature of Court Master.
