% 27.11.2017 The Government of Delhi‟s grievance in this Letters Patent Appeal is that Single Judge directed re-examination of the writ petitioner‟s application on merits. It contends that the application for alternative plot was made 8 days after expiry of the period of limitation indicated in its guidelines.
The Court is of the opinion that no infirmity can be found with the impugned judgment given that the period of limitation is not mandated by statute and is rather part of the guidelines of 30.11.1993. In this case, the applicant approached the authorities merely a week after the expiry of that stipulated date. The guidelines, therefore, could not be considered as invariable and defeat his claim for examination on the merits.
LPA No.750/2017
The appeal is, therefore, dismissed.
