% 07.10.2016 Learned counsel appearing on behalf of the parties state that the parties have entered into an amicable settlement qua the underlying dispute, which led to the initiation of the present proceedings, inasmuch as, learned counsel appearing on behalf of respondent company, has handed over a cheque bearing no. 179542, dated 7th October, 2016, drawn in favour of the petitioner company, for a sum of Rs. 1,56,500/- towards full and final settlement of the latter's claim in the present petition, to learned counsel appearing on behalf of the petitioner, in Court today.

Ms. Isha Khanna, learned counsel appearing on behalf of the petitioner acknowledges receipt of the above said cheque, subject to its encashment. In view of the foregoing, Ms. Khanna, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition with liberty to approach this Court in the event the above said cheque is not encashed. Leave and liberty granted.

The present petition is dismissed as withdrawn and disposed of accordingly.

Pending applications, if any, also stand disposed of.
