Learned counsel on behalf of the plaintiff submits that the Preliminary Decree has been passed defining the shares of the parties, vide Order dated 22.08.2022. The suit property is C-707, New Friends Colony, New Delhi, which is constructed on the plot of 500 square yards, in which seven legal heirs have been held to be entitled to a share. It is evident that this property cannot be divided by metes and bounds as per Municipal Bye Laws. Therefore, the share of the parties can be satisfied only by sale of the suit property.

Accordingly, it is hereby directed that the suit property be sold and the sale proceeds be distributed in accordance with the shares of the parties as defined in the Preliminary Decree dated 22.08.2022. 3.
