The petitioner, who is working on the post of Assistant Commandant, Border Security Force (BSF), has filed the present petition, praying inter alia that his resignation from the services of Central Industrial Security Force (CISF), be treated as a technical resignation so that he can take the benefit of the services rendered by him in the CISF and resultantly claim the benefit of the Old Pension Scheme.

Mr.Chhibber, learned counsel for the petitioner, states that the petitioner has submitted several representations to the respondent no.3/CISF for the aforesaid relief, but the said representations remained pending. In the last reply dated 20th September, 2017, forwarded by the Assistant Commandant(Personnel) of the CISF, it was informed to the petitioner that his request has been forwarded to the higher authorities for necessary action. Learned counsel for the respondents who appears on advance notice, states that the petitioner‟s representations are pending with the higher authority and a decision thereon shall be taken by respondent nos.2 & 3 within four weeks under written intimation to him. 4.

While binding the respondents to the time line prayed for, the present petition is disposed of along with the pending application. 5.
