% 27.11.2017 Crl.M.A. 19537/2017 Exemption allowed subject to just exceptions. W.P.(CRL) 3321/2017 By the present petition the petitioner seeks quashing of FIR No. 503/2017 under Sections 352/341/506 IPC registered at PS Jafrabad, Delhi on the complaint of Respondent No.2 and the proceedings pursuant thereto on the ground that the parties have settled the matter. Learned Additional Standing Counsel for the State on instructions from Investigating Officer submits that petitioner is the only accused and respondent No.2 the only complainant. He further states that the petitioner and respondent No.2 are related, the petitioner being the son-in-law of respondent No.2.

Respondent No. 2 is present in Court and is identified by the W.P.(CRL) 3321/2017

Investigating Officer. She states that she has settled the matter with the Petitioner in terms of the settlement deed annexed as Annexure B to the present petition. In terms of the said settlement the misunderstandings which grew between the petitioner and respondent No.2 and her daughter who is the wife of the petitioner are now clear and petitioner has agreed to keep and maintain his wife, i.e. the daughter of respondent No.2 as per his status in the matrimonial home at E-538, Street No.22/1, Near MCD School, Old Mustafabad, Delhi. She states that she does not wish to pursue the abovementioned FIR and the proceedings pursuant thereto. In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No. 503/2017 under Sections 352/341/506 IPC registered at PS Jafrabad, Delhi and proceedings pursuant thereto are hereby quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

Petition is disposed of. Order dasti.
