O R D E R

% 07.02.2019 On 7th December, 2018 an order was passed for temporary desealing of the subject premises to enable the petitioners herein to remove their equipment / plant and machinery. It is submitted by learned counsel for the petitioner that they wrote a letter dated 12.12.2018 asking the respondent to allow them to remove their plant and machinery and also gave them the required

affidavits, thus complying with the requirements but they were not allowed to remove their belongings.

The learned counsel for the respondent says the equipments were not handed over since the petitioner of W.P.(C) 9953/2018 i.e M/S Meera Engineering Company had sent a letter to the respondent asking the respondent not to allow the petitioners herein to remove their respective plants and machinery and that property be not desealed until and unless the petitioners herein furnish 'No Due Certificates' issued by M/S Meera Engineering Company. The dues of M/S Meera Engineering Company against the petitioners herein is a separate issue and cannot come in the way of order passed on 7th December, 2018. It would be appropriate if the petitioners along with a representative of M/S Meera Engineering Company be present on the disputed premises tomorrow i.e. 8th February, 2019 at 10 AM. The Estate Manager of DSIIDC shall also be present in the premises in dispute and shall comply with the order dated 7th December, 2018. As submitted since the plant and machinery is heavy, it may take some time to dismantle, which fact may be considered by the respondent - DSIIDC. List on 13th May, 2019.

Copy of the order be given dasti under signature of the Court Master.
