% 06.08.2018 After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition reserving the right to approach the court which passed the impugned order under Section 439(2) of Code of Criminal Procedure, 1973. The contention of the second respondent questioning the locus of the petitioner to seek such relief is reserved and may be agitated before the court concerned.

The petition stands dismissed as withdrawn.
