1. The no dues certificate issued by the Plaintiff to the Defendant has been perused.
2. Counsel for the Plaintiff states that he may be permitted to unconditionally withdraw the suit.
3. The application is allowed.
CS(OS) 3110/2015 & IA Nos. 21790 of 2015 & 21787 of 2015
4. The suit and the pending applications are dismissed as withdrawn.
5. Counsel for the Plaintiff states that since this withdrawal is on account of out of court settlement, the Plaintiff is entitled to return of half of the court
fee in terms of Section 16A of the Court Fees Act, 1870 .
6. The Registry will now prepare, and issue to the Plaintiff, within two weeks from today, a certificate entitling the Plaintiff to receive back from the Collector of Stamps, half of the court fees paid by the Plaintiff on the plaint.
