The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.773/2014 registered under Sections 376/363 IPC and sections 4 POCSO Act at PS Kirti Nagar, Delhi. Status report is on record.

The petitioner is in custody since 13.11.2014. Statement of the prosecutrix has already been recorded completely; copy of which has been placed on record. She was on the verge of attaining majority. The prosecuterix and the petitioner were known to each other before the incident as the petitioner lived in her neighbourhood. On 06.11.2014 allegedly the petitioner had called the victim on telephone at Kirti Nagar Metro Station from there they went to a park, had talk for some time and thereafter, the petitioner took her to the room BAIL APPLN. 2355/2015

where he allegedly committed rape upon her. After the incident, she was left at Ramesh Nagar Metro Station.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the Trial Court.

The bail application stands disposed of.

It appears that due to inadvertence mediation report pertaining to some other case has been attached to this file. 6.

Registry is directed to take necessary steps to detach the mediation report from the file.
