% 27.11.2017 During the course of hearing, the only point pressed by the learned counsel for the petitioner is that any observation made regarding relevance of the contradictions in the impugned order passed on the application under Section 311 Cr.P.C. shall not affect the merits or demerits of the case at the time of final trial. She seeks leave to withdraw the petition. Petition is disposed of as not pressed with the clarification that any observation made touching the merits of the case will not affect the prosecution case, at the time of final disposal of the matter.
