Vide the present petition under Section 439 Cr.P.C, the petitioner seeks grant of regular bail.

Learned counsel for the petitioner submits that as per the FIR, the petitioner is alleged to have eloped with the complainant's daughter Ms.Sangeeta, who was stated to be 16 years old at the time. He submits that the petitioner and Ms.Sangeeta, who has since attained the age of majority, are already married. Furthermore, they are already blessed with one child and Ms.Sangeeta is also presently pregnant. He submits that there is no other family member who can take care of the petitioner's minor child and his wife, who is at an advanced stage of pregnancy.

Ms.Arya, learned APP does not dispute the aforesaid submissions of learned counsel for the petitioner. 4.

Keeping in view the facts and circumstances of the case and without commenting on the merits thereof, I am of the view that the petitioner has made out a case for being released on bail. It is accordingly directed that subject to the petitioner furnishing a personal bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the learned Trial Court, he will be released on bail. It is made clear that during the said period, the petitioner will not leave the NCR without the prior permission of this Court and will not try to contact any of the prosecution witnesses or hamper the investigation in any manner. The petitioner will also furnish two mobile numbers on which he can be contacted and both of them will be kept activated at all times. One of the aforesaid mobile numbers will be that of the petitioner himself. 5.

The petition is disposed of in the above terms. 6.

A copy of this order be given dasti under the signatures of the Court Master.
