% 20.01.2016 The present is an application under Section 438 of the Code of Criminal Procedure, 1973 (Cr.P.C.) seeking anticipatory bail in FIR No.691/2014, under Sections 420/467/471/406/506/120-B/34 IPC, registered at Police StationAnand Vihar. In the present case, it is an admitted position that the applicant has since joined investigation and has made himself available for questioning as and when called upon to do so. In the present case, it is observed that the applicant has clean antecedents and has no other previous involvements. At this stage, there is no hint or allegation that he shall not be available to stand trial or that he shall tamper with the evidence. Mr. Oberoi, learned APP appearing on behalf of the official respondent, on instructions from the IO SI Anuj Kumar, Police Station- Anand Vihar states that the charge sheet in the subject FIR has already been filed before the trial court on 22.09.2015.

In view of the foregoing, the present application is allowed. In the event of his arrest, the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety of the like amount to the satisfaction of the Arresting Officer/Station House Incharge subject to the further conditions that he shall appear before the trial court on every date of hearing unless otherwise directed and he shall surrender his Passport, if any, to the IO in the subject FIR namely SI Anuj Kumar, Police Station- Anand Vihar within two days.

The application is disposed of accordingly.
