A settlement agreement dated 7th April, 2016 in original has been received from the mediation centre which has been marked as 'Mark - I'. The same has been shown to the parties. The appellant - Sunita Gupta identifies her signatures at point 'X-1' on the settlement agreement.

The respondent - Hari Om Gupta also identifies his signatures at point 'Y-1' on the settlement agreement. The agreement is signed by Mr. H.S. Gautam, learned counsel for the appellant and Mr. Sudhir Balyan, learned counsel for the respondent. The settlement agreement has also been signed by the learned mediator.

It is submitted by the parties that they have voluntarily entered into the settlement agreement without any kind of force, MAT.APP.(F.C.) 126/2015

pressure or undue influence.

Both the parties have given undertaking in the settlement agreement that they shall remain bound by the terms of the settlement agreement. 3.

Both the parties pray that the settlement agreement may be accepted and taken on record.

It appears that the settlement agreement has been entered into by the parties voluntarily and without any kind of force, pressure or undue influence. There is no legal impediment to the acceptance of the same. 4.

A prayer is made that the appeal may also be disposed of in terms of the present settlement agreement.

In view of the above, we direct as follows :

(i) The settlement agreement dated 7th April, 2016 is accepted and taken on record.

(ii) The undertaking given by the parties to remain bound by the terms of the settlement agreement stands accepted. The parties shall strictly abide by the terms of the settlement. This appeal is disposed of in terms of the settlement agreement.

List this matter for reporting working out of the settlement on 12th May, 2016.
